GUANTÁNAMO: DOS ANYS DE SEGREST DELS DRETS HUMANS

Carta al president George Bush per demanar justícia per als detinguts de Guantánamo.
Distingit Sr. President,
Ja han passat dos anys des que els primers presos van ser traslladats a la badia de Guantánamo. Aquesta reclusió indefinida i perllongada vulnera el principi jurídic fonamental que totes les persones han de tenir la possibilitat de recórrer la legalitat de la seva detenció. Vostè ha promès en diverses ocasions que els Estats Units defensaran amb fermesa "les exigències no negociables de la dignitat humana", l'Estat de dret inclòs. Per a moltes persones, aquestes paraules estan buides de contingut mentre no existeixi un procés judicial per als detinguts de Guantánamo.
Per tant, li demano que garanteixi que tots el reclusos de Guantánamo, si no són acusats formalment i jutjats amb les degudes garanties, siguin alliberats. Per altra banda, els judicis a càrrec de les comissions militars previstos en el seu ordre militar semblen no complir allò establert en les normes internacionals.
També preocupa el destí dels detinguts que, de ser retornats als seus països, podrien córrer el risc de patir violacions greus dels drets humans, com és el cas dels uigures que podrien ser retornats a la Xina. Hi ha el temor que aquest risc s'hagi vist incrementat amb les declaracions tant de vostè com d'altres alts càrrecs del seu país en qualificar els reclusos de "terroristes" i "assassins".
Per tant, li demano la garantia que ningú serà retornar a la força a un país on pugui patir violacions dels seus drets humans.

Dear Mr President,
It is now two years since the first prisoners were transferred to Guantánamo Bay. This prolonged indefinite detention violates a fundamental legal principle that anyone must be allowed to challenge the lawfulness of their detention. You have repeatedly promised that the USA will stand firm for the "non-negotiable demands of human dignity", including the rule of law. For many, these words have rung hollow as the lack of legal process for the Guantánamo detainees continues.
I call on you to ensure that all those held in Guantánamo are released if they are not to be charged and brought to fair trial. I do not believe that trials by the military commissions envisaged in your Military Order would meet international standards.
I am also concerned for the fate of those detainees who might, if returned to their countries, risk serious human rights violations, including ethnic Uighurs facing possible return to China. I fear this risk has been increased by public statements by you and other senior US officials, labelling those held as "terrorists" and "killers".
I urge you to ensure that no-one is forcibly returned to a country where they would face serious human rights violations.
